Court Nullifies Abia Civil Service Circular Disengaging Non-Indigene Mrs Anikwendu

The National Industrial Court sitting in Portharcourt has declared the Abia State Civil Service Commission circular dated August 25, 2011, which transferred the services of Mrs. Anikwendu from the Abia State Civil Service on the grounds that she is not an indigene of the state, as discriminatory, unconstitutional, null, and void.

Delivering judgment, the Presiding Judge of the Portharcourt Judicial Division, Hon. Justice Faustina Kola-Olalere, held that the circular contravened Section 42 of the Constitution of the Federal Republic of Nigeria, 1999, and did not comply with the Abia State Government Public Service Rules.

The court found that Mrs. Anikwendu was not properly disengaged from the Abia State Civil Service Commission, describing the purported disengagement as unconstitutional. The judge emphasized that her employment was protected by statutory provisions, meaning her removal must strictly follow due process.

According to court records, Mrs. Anikwendu had argued that her employment was unlawfully terminated and that the Abia State Universal Basic Education Board, which issued the disengagement letter, lacked the legal authority to do so. Her counsel, Wisdom Chude Esq, maintained that the actions of the Governor of Abia State, the Abia State Civil Service Commission, and others in removing his client from office based on her non-indigene status were unconstitutional.

Chude urged the court to safeguard her constitutional rights, declare the action illegal, reinstate her, and order the payment of her arrears of salaries and emoluments.

In defense, the Executive Governor of Abia State, the Civil Service Commission, the Abia State Universal Basic Education Board, and the Attorney General of Abia State argued that her case was barred by the provisions of the Abia State Public Officers’ Protection Law, the Limitation Law of Abia State, and the Limitation Law of Rivers State 1999. They urged the court to dismiss the suit, describing it as stale and incompetent.

They further submitted that Mrs. Anikwendu could not claim continuing injury because the alleged wrongful act occurred in 2011, while the case was only filed in 2024.

However, her counsel countered that limitation laws could not protect defendants who acted outside their constitutional duties, urging the court to reject the objection.

In her ruling, Justice Kola-Olalere dismissed the preliminary objection, holding that the actions of the governor, the civil service commission, ASUBEB, and the attorney general were not protected by the cited limitation laws because they acted outside the scope of their official powers.

The court described the defendants’ actions as prima facie violations of Section 42 of the 1999 Constitution and not in execution of any lawful state policy or authority.

The judge stressed that Mrs. Anikwendu’s position was one with statutory protection and that any disengagement must strictly follow the Abia State Public Service Rules, which was not done in this case.

Consequently, the court set aside the disengagement and ordered her reinstatement to her position with effect from the date of her removal.

Justice Kola-Olalere also ordered the payment of all her outstanding salaries and allowances from the time of her unlawful disengagement.

“I hereby order that the defendants shall pay the total judgment sum, including the cost of this action to the claimant within three months from today. If, after three months, the defendants still fail to totally pay the judgment sum, the judgment sum or the balance thereon shall attract annual interest of 15% until the judgment sum or its balance is fully liquidated,” the judge ruled.

This ruling reinforces the constitutional protection against discrimination based on state of origin and reaffirms that public service rules must be followed when terminating employment in the civil service. It also sets a precedent on the limits of the Public Officers’ Protection Law when actions are taken outside constitutional authority.

“Stage 2 of your application has officially begun,” the organisers stated. Candidates are required to submit a 2-minute video introducing themselves, explaining why they are applying, and highlighting what makes them the perfect fit.

The video must not exceed 10MB. The programme is powered by the Kaduna State Bureau of Statistics, the Gates Foundation, and NETI.

August 6, 2025 – The Sen. Sunday Steve Karimi Education Foundation and Tinubu Support Group have announced that the registration process for the 2025 bursary scheme is now running smoothly. According to the organisers, all technical glitches that occurred between Friday, August 1, and Saturday, August 2, have been resolved, allowing applicants to register without difficulty.

Abia Govt Hosts Two-Day Trade Development Programme in Aba

On August 6, 2024, the Abia State Government commenced a two-day Trade Development Programme at Panyu Hotel, Aba. Abia Leadership Academy CBT and Interviews Date 2025

Registration for the first cohort of the Abia Leadership Academy closed on Monday, August 4, 2025, with about 2,000 applications received from interested participants.

According to the organisers, the registration portal at abiastate.gov.ng/leadershipacademy will, however, remain open until Monday, August 11, 2025, for subsequent cohorts.

The programme is designed for young people between the ages of 16 and 20 who are currently enrolled in recognised public or private institutions of learning. Organisers urged eligible youths not to miss the opportunity, as the Academy promises to provide mentorship in an environment set up by Governor Alex Otti. “It promises to be a life-changing experience for every participant,” a statement read.

The test will cover basic knowledge expected of individuals within the specified demographic. The training programme will be residential, with a dedicated facility in Umuahia prepared to host and train 1,000 young people between now and the first week of September. Each week, a cohort of 250 participants will be accommodated for a 7-day residency.

The programme will feature mentally stimulating activities, physical exercises, group discussions, assignments, and other engagements aimed at preparing participants for leadership responsibilities.

Certificates will be presented to those who successfully complete the programme, while prizes will be awarded to the most outstanding individuals. All participants who complete the training will also receive stipends to cover transport costs.

The Abia Leadership Academy is designed to go beyond the initial training period, establishing a community of achievers, visionaries, and thinkers. Members will continue to collaborate on governance and enterprise projects, engage in periodic meetups, and share ideas to improve their communities.

The Federal Government of Nigeria has restated its commitment to strengthening trade and investment relations with the United States as part of efforts to boost economic growth and development.

This was highlighted during a meeting in Abuja between the Honourable Minister of Finance and Coordinating Minister of the Economy, Mr Wale Edun, and the United States Consul General to Nigeria, Mr Rick Wart. The Minister, who was represented by the Ministry’s Permanent Secretary, Mrs Lydia Shehu Jafiya, noted the historic and strategic bilateral relationship between both countries.

Mr Edun stressed that Nigeria values its partnership with the United States and will explore new areas to expand investment opportunities, drive innovation, and support sustainable development in line with the Renewed Hope Agenda of President Bola Ahmed Tinubu. He added that the Federal Government is focused on creating an enabling environment for foreign direct investors to unlock new opportunities in the country.

According to him, improved cooperation between Nigeria and the United States supports the administration’s economic reform agenda, which prioritizes private sector participation, fiscal sustainability, and inclusive growth.

AGILE, SBMC Sign Agreement for School Improvement Grant Disbursement

The AGILE Project Coordinator, Hajiya Aishatu Aliyu Isoga, on Tuesday convened a strategic meeting at Government Science Secondary School (GSSS), Lafia, with the School Improvement Grant (SIG) Consultant, Chief Education Officers (CEOs), and School-Based Management Committee (SBMC) school-level signatories.

The meeting focused on finalizing and signing the indemnity agreement ahead of the disbursement of the School Improvement Grants to qualified public secondary schools across the Southern and Northern Zones of the state.

“We are set to disburse funds into various SBMC accounts, provided that all signatories have signed the indemnity agreement and complied with our guidelines,” Hajiya Aishatu stated. She noted that beneficiary schools have prepared well-prioritized School Improvement Plans ready for implementation, and only those meeting the set criteria will receive funds in the first phase.

According to her, only signatories to accounts opened with Fidelity Bank will be allowed to sign the indemnity agreement, while requests for changes in account signatories will only be considered if there is a valid reason.

“This is a community development project, and we want full community involvement. That is why the SBMC Chairman and Treasurer must come from the community. On no account should the Principal or Treasurer be a staff member of the school; this is to ensure transparency,” she explained.

The Lead Consultant for the AGILE School Improvement Grant, Qs. (Dr) Ruwa T. Fadason, supervised the practical signing exercise and briefed SBMC officials, especially Principals, on the rules of engagement. He cautioned them against any form of financial mismanagement, warning that it could affect their salaries, retirement benefits, and even personal assets.

The signing of the indemnity agreement is seen as a major step toward promoting accountability and transparency in the use of SIG funds, which aim to improve the quality of education, enhance learning environments, and strengthen governance structures in public schools.

The event’s highlight was the official signing of the indemnity agreement by eligible SBMC officials, marking the readiness for the upcoming SIG disbursement.

Edo Govt Bans NURTW, RTEAN, ANNEWAT, Others Over Illegal Levies

The Edo State Government, led by Governor Senator Monday Okpebholo, has announced an immediate and indefinite ban on the activities of certain transport unions and organizations over alleged illegal revenue collection and extortion across the state.

In a statement, the government expressed deep concern about the resurgence of illegal levies, noting that some groups earlier given limited authorization to work with the Edo State Internal Revenue Service (EIRS) under clear conditions had violated the terms of engagement.

According to the announcement, these groups resorted to cash collections, extortion, social harassment, and intimidation of motorists and traders.

Governor Okpebholo named the affected unions as the National Union of Road Transport Workers (NURTW), Road Transport Employers Association of Nigeria (RTEAN), ANNEWAT, and Drivers on Wheel. He declared that none of these unions are permitted to collect dues, levies, taxes, or charges from any member of the public in Edo State.

The ban also includes Atalakpa Recovery Concept Ltd, a private consultant previously engaged to enforce compliance. Reports reaching the governor indicated that the firm and its workers had been involved in widespread extortion, violating the trust placed in them.

“These actions are acts of economic sabotage, social oppression, and a direct affront to law and order,” the statement read. “The era of using unions as fronts to harass, intimidate, or extort drivers and road users in the name of revenue collection is over.”

The government ordered that no individual or group from the banned unions should collect payments from motorists or road users. It further advised drivers and road users to refuse any illegal levy imposed by these entities and to report such incidents immediately to the Edo State Special Taskforce, coordinated by SP Michael Anetor, via 08038157126.

The Commissioner of Police and other security agencies have been instructed to arrest and prosecute anyone violating the directive.

Governor Okpebholo emphasized that the administration remains committed to sanitizing the state’s revenue system and protecting residents from unlawful exploitation.

“Let this serve as a final warning to all parties engaged in or considering such illegal activities: the full weight of the law will be brought upon you,” he warned.

The directive is part of the government’s broader plan to ensure lawful revenue generation, boost economic growth, and maintain peace across Edo State, in line with its pledge to protect citizens’ rights and promote a fair business environment.
